Terms of Service

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Banana Ultra mobile application (the "Service") operated by the individual developer ("Developer", "Us", "We", or "Our").

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service You agree to be bound by these Terms. If You disagree with any part of the terms then You may not access the Service.

Interpretation and Definitions

The definitions provided in Our Privacy Policy are incorporated by reference into these Terms of Service. For the purposes of these Terms:

  • Account means a unique anonymous account generated by Our Service (via Supabase anonymous authentication) for You to access the Service.

  • Application refers to Banana Ultra, the software program provided by the Developer.

  • Premium Subscription means a recurring, auto-renewing subscription (e.g., "BananaUltra Weekly" or "BananaUltra Monthly") offered through the Service that grants access to premium features, managed via Apple (App Store) or Google (Play Store) and processed by RevenueCat, Inc.

  • Subscription Credits (e.g., subscription_credits) means the "rental" allowance of credits (e.g., 5 or 30) granted as part of an active Premium Subscription. These credits are temporary and reset at the beginning of each billing period.

  • Consumable Credits (e.g., consumable_credits) means "permanent" credits (e.g., "10 Credits") purchased via a one-time In-App Purchase. These credits are stored in Your Account wallet.

  • Generated Content means any images, text, or other material created by You using the AI capabilities of the Service.

  • You means the individual accessing or using the Service.

User Accounts

To use Our Service, an anonymous Account is automatically created for You. You are not required to provide an email, password, or name.

This Account is tied to Your specific installation of the Application on Your Device. You are responsible for safeguarding Your Account.

WARNING: Because Your Account is anonymous, if You delete the Application from Your Device, or if Your Device is lost, stolen, or reset, Your anonymous Account ID may be permanently lost. We cannot recover lost anonymous accounts. Any remaining Consumable Credits or active Premium Subscriptions associated with that lost anonymous Account will also be permanently lost and are non-refundable.

In-App Purchases and Subscriptions

The Service includes paid Premium Subscriptions and one-time Consumable Credits (In-App Purchases).

Premium Subscriptions (Weekly & Monthly)

Auto-Renewal: All Premium Subscriptions are auto-renewing. This means You will be billed in advance on a recurring, periodic basis (either weekly or monthly). Your subscription will automatically renew at the end of each billing cycle unless You cancel it through Your device's Subscription Management settings (e.g., Apple ID Settings or Google Play Store Settings) at least 24 hours before the renewal date.

Cancellations: If You cancel Your Premium Subscription, You will retain access to the premium features and Your remaining Subscription Credits until the end of Your current paid billing period. You will not be charged for the next period.

Forfeiture of Subscription Credits (The "Rental" Wallet): subscription_credits are temporary and do not roll over. When Your Premium Subscription period expires (either from non-renewal, cancellation, or a billing failure), any unused Subscription Credits in Your rental wallet from that period are immediately and permanently forfeited (reset to 0). They do not transfer to Your permanent wallet.

Consumable Credits (The "Permanent" Wallet)

One-Time Purchase: Consumable Credits (e.g., "10 Credits") are a one-time, non-recurring purchase (In-App Purchase).

No Expiration: Purchased Consumable Credits (consumable_credits) are stored in Your anonymous Account wallet and DO NOT EXPIRE, as long as Your Account exists (see "User Accounts" warning above).

Refunds: All purchases (both Premium Subscriptions and Consumable Credits) are final, non-refundable, and non-transferable.

Acceptable Use Policy (Content Policy)

You agree not to use the Service to create, upload, or share any Generated Content that:

  • Is illegal, harmful, threatening, abusive, or harassing.
  • Violates any laws regarding child sexual abuse material (CSAM) or exploitation.
  • Promotes hatred, violence, or discrimination based on race, gender, religion, nationality, disability, or sexual orientation.
  • Infringes on any third party's intellectual property rights (e.g., copyrights or trademarks).
  • Is deceptive or fraudulent (e.g., creating "deepfakes" for misinformation).
  • Is sexually explicit or pornographic. (This is strictly prohibited to comply with App Store and Google Play policies).
  • Attempts to reverse-engineer, decompile, or discover the source code of the Application or the AI models it uses.

We reserve the right, but not the obligation, to monitor content and to remove any Generated Content or terminate Your Account for violating these Terms.

Intellectual Property

The Service and its original content (excluding Generated Content), features, and functionality are and will remain the exclusive property of the Developer. The Application is protected by copyright, trademark, and other laws of both Turkey and foreign countries.

Your Generated Content: Subject to Your compliance with these Terms (especially the Acceptable Use Policy), You own the rights to the Generated Content You create using the Service. You are free to use Your Generated Content for personal or commercial purposes.

Termination

We may terminate or suspend Your Account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms (especially the Acceptable Use Policy).

Upon termination, Your right to use the Service will cease immediately. If Your Account is terminated, You will forfeit all remaining Subscription Credits and Consumable Credits associated with Your Account, and no refund will be provided.

Limitation of Liability & Disclaimer ("As Is")

The Service is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Developer expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service.

The AI models used by the Service are complex and may produce inaccurate, biased, or offensive Generated Content. We are not liable for any Generated Content or any damages arising from Your use of the Service.

In no event shall the Developer be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, or loss of privacy) arising out of or in any way related to the use of or inability to use the Service.

Governing Law

The laws of the Country (Turkey), excluding its conflicts of law rules, shall govern these Terms and Your use of the Application. Your use of the Application may also be subject to other local, state, national, or international laws.

Changes to These Terms of Service

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. We will let You know via a prominent notice on Our Service, prior to the change becoming effective and update the "Last updated" date at the top of these Terms.

By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms.
